Definitions
References in these terms and conditions to ‘you’ and ‘your’ shall mean the person who makes a booking with us to attend one of our courses run at or from Aqua Parcs. Where the person participating in the course is not the person making the booking then references to ‘you’ and ‘your’ shall also include the participant where the context permits this.
References in these terms and conditions to ‘we’, ‘us’, ‘our’ and Aqua Parcs Limited ‘means Aqua Parcs Limited (company number 11087619) whose registered office is at 2nd Floor Finance House, 20/21 Aviation Way, Southend On Sea, Essex, United Kingdom, SS2 6UN.

Price and Payment
All sessions must be paid in full at the time of booking. Any due discount will be applied at the time of booking.


Cancellation, Failure to Attend and Exclusions
Whilst we try to ensure that all sessions proceed on the date specified, there may be occasions, beyond our control when this will not be possible and we reserve the right to cancel a session in those circumstances. Examples of such circumstances: circumstances arise that are outside of our control, e.g. adverse weather, floods, fire, acts of God etc.
In such circumstances, you will be notified as soon as reasonably practicable and an alternative date will be offered to you. If there are no alternatives dates convenient for you, we shall refund the amount you have paid for that course in full. We will not be liable for any other expenditure or costs incurred by you in the event of such cancellation and you are advised to take out your own cancellation insurance to cover such eventuality.
You may cancel your attendance on a course by notifying us by email to the following email address: info@aquaparcs.co.uk
If you notify us that you would like to reschedule your session more than 48hours prior to the session date, we will be able to proceed with the change with no extra cost.
If you notify us that you would like to cancel your session more than 7days prior to the session date we will be able to give you vouchers so that you can rebook a session at a later date during the season.
Aqua Parcs limited does not offer any refund for cancellation.
Should you fail to arrive on time for the session then you shall not be permitted to attend the remaining sessions unless we, at our discretion, otherwise agree. If we do permit you to attend subsequent sessions you will not be entitled to any refund for the missed time.
Any person who is excluded from a session for any reason shall not be entitled to a refund.

Medical Conditions
All participants must be physically fit and capable of participating in the course being booked. Should you have any concerns whether you are capable of participating in the session then we advise you to speak to one of our on-site managers who can explain what the session will involve. If you still have any concerns whether you are capable of participating in the session you should check with your doctor before booking.
We reserve the right to refuse any booking on medical grounds if we consider it to be detrimental to the safety and smooth running of the session or the safety of the other participants on the session.
We also reserve the right at any time (including after a session has started) to exclude a participant from a session where in our opinion that person is unable to safely take part in that session (whether for medical reasons or because of any disability or physical impairment or weakness).

Statement of Risk
Upon attending your session (or the first session of your booking where it involves two or more sessions) you will be required to sign a Statement of Risk.
Parents or guardians of participant who are under 18 years of age will be required to complete a similar Statement of Risk on behalf of the participant.
A link to the online copy of such Statement of Risk is sent out with the booking confirmation. Failure to complete this form prior to the start of the course will result in you (or the participant concerned) being refused admission to the course unless you pay a £5 administration fee to complete the Statement of Risk on paper.

Participants under 18
8 to 12-year-old participants must have an adult in or around the facility.

13 to15-year-old participants need an adult to sign them in.

16&17-year-old participants need an adult to sign them in if the SOR has not been completed before arrival and will be charged £5 each.


Safety
Participating in any water sport carries an inherent risk of injury and drowning. To minimise such risks you must comply with all safety regulations and instructions. We reserve the right to exclude participants from any session if they appear intoxicated or engage in inappropriate behaviour or if they fail to follow any safety regulations and instructions that our staff may give.

Equipment
All equipment required to participate in a course will be provided by us. This includes suitable buoyancy aids and wetsuits. Participants owning their own wetsuits are welcome to use such equipment, subject to the suitability of the equipment. We reserve the right to require you to use our equipment where we deem your equipment to be unsafe or unsuitable.
Participants should bring a complete change of clothes, swimwear, a towel, a padlock for the lockers and, if needed, aqua shoes with no hard sole.


EXCLUSION OF LIABILITY
By booking attendance on a session you are deemed to acknowledge and understand that Aqua Parcs Limited and its staff and agents accept no responsibility for any loss injury or damage suffered by any participant which results from taking part in that session except where this can be shown to result directly from the negligence of Aqua Parcs Limited and its staff and agents.
